Role of FlexTrip

FlexTrip provides travel planning, coordination, and booking facilitation services. When requested by a client, FlexTrip may book activities, accommodations, transportation, nightlife, or related travel experiences on the client's behalf using independent third-party suppliers.

FlexTrip is not a tour operator, carrier, or activity provider.


Third-Party Services

All travel services are provided by independent third-party companies. FlexTrip does not operate, control, or supervise these services and is not responsible for the actions, omissions, safety, quality, scheduling, performance, or outcomes of any third-party provider.


Insurance

FlexTrip is not an insurance provider, broker, or agent. We do not sell, underwrite, or administer insurance policies of any kind. Any insurance providers referenced, recommended, or linked on our website or in our communications are independent third-party companies. Any policy purchased is a direct contract between the client and that provider. FlexTrip makes no representations or warranties regarding coverage, claims, eligibility, pricing, or service from these providers and is not liable for any disputes, denials, losses, or damages arising from your relationship with them.

Travel and medical insurance are strongly recommended for all trips and may be required by certain destinations, universities, or trip types. Should emergency medical services become necessary, the client understands that all expenses are their sole responsibility and not that of FlexTrip.


Pricing & Payments

Prices charged by FlexTrip may include planning, coordination, facilitation, administrative, and booking services in addition to the underlying cost of the third-party experience.

Payment authorizes FlexTrip to book services on the client's behalf. All prices are presented as all-in unless otherwise stated.


Cancellations, Changes & Refunds

All cancellations, changes, and refunds are subject solely to the policies of the third-party supplier. FlexTrip does not guarantee refunds and is not responsible for supplier denials, partial refunds, or non-refundable bookings.


Assumption of Risk

Travel and activities may involve inherent risks, including but not limited to injury, illness, delays, cancellations, weather conditions, or unforeseen events. By booking through FlexTrip, the client voluntarily assumes all such risks.


Limitation of Liability

To the fullest extent permitted by law, the client agrees that FlexTrip shall not be liable for any loss, damage, injury, delay, cancellation, expense, or inconvenience arising from or related to any third-party service, including acts of negligence, force majeure events, or circumstances beyond FlexTrip's control.


Communications & Email Consent

By providing your contact information in connection with a booking or inquiry, you agree that FlexTrip may contact you via email for transactional purposes (including confirmations, updates, and support) and, where permitted by applicable law, for marketing purposes such as newsletters, promotions, and travel offers.

You may opt out of marketing communications at any time by clicking the unsubscribe link included in such emails. Transactional communications related to your bookings will still be sent as necessary.


No Warranties

FlexTrip makes no warranties, express or implied, regarding the availability, quality, safety, or suitability of any third-party service.


Agreement to Terms

By completing payment, the client acknowledges that they have read, understood, and agreed to these Booking Terms & Disclaimer and authorizes FlexTrip to act as a booking facilitator on their behalf.


Flex+ Membership Terms

Membership Overview

Flex+ is a subscription-based service that provides members with access to exclusive benefits, including but not limited to travel planning support, concierge assistance, discounts, curated recommendations, and access to select events, services, or partners. Benefits may vary by membership tier and are subject to change at any time.


Billing & Subscription

Flex+ memberships may be offered on a monthly or fixed-term (e.g., semester or seasonal) basis. By purchasing a membership, you authorize FlexTrip to charge your selected payment method according to the plan chosen.

Monthly memberships will automatically renew on a recurring basis unless canceled prior to the next billing cycle.


Cancellations & Refunds

Monthly memberships may be canceled at any time prior to the next billing cycle. Cancellation will stop future charges but will not result in a refund for the current billing period.

All fixed-term memberships (including but not limited to semester, seasonal, or promotional plans) are non-refundable once purchased, regardless of usage, travel changes, or early termination.


Use of Services

Flex+ benefits are intended for the individual member or their designated group and may not be resold, transferred, or shared beyond reasonable personal use. FlexTrip reserves the right to limit or revoke access if abuse, misuse, or excessive demand is detected.

FlexTrip does not guarantee availability, pricing, or access to any specific deal, activity, or experience offered through membership.


Third-Party Services

Many Flex+ benefits involve third-party providers. FlexTrip does not control or guarantee the performance, availability, or outcomes of any third-party services, and all such services remain subject to the provider's terms and policies.


Insurance Access

Flex+ plans may include "Access to Medical Health & Travel Insurance" as a referenced benefit. This means members are provided with information about and links to independent third-party insurance providers. FlexTrip does not provide, sell, or guarantee insurance coverage of any kind. All policies are purchased directly from the third-party provider, subject to that provider's terms, eligibility, and pricing. FlexTrip is not liable for coverage disputes, claims, or denials.


Modifications to Membership

FlexTrip reserves the right to modify, replace, or discontinue any aspect of the Flex+ membership, including pricing, benefits, or structure, at any time. Continued use of the membership constitutes acceptance of any such changes.


Termination

FlexTrip reserves the right to suspend or terminate membership access at its discretion in cases of misuse, violation of these terms, or behavior deemed harmful to the business, partners, or other clients.


No Guarantees

FlexTrip does not guarantee savings, availability of deals, or specific outcomes from use of the membership. Membership is provided as a value-add service and results may vary based on usage, destination, timing, and external factors.


MyAbroadMDs Terms of Service

Applies to Flex+ Protected and Flex+ Ultimate members who receive access to MyAbroadMDs services through their Flextrip membership.

These Terms of Service (“Terms”) govern your access to and use of the MyAbroadMDs website located at www.myabroadmds.com and any related mobile applications (collectively, the “Platform”). The Platform is owned and operated by MyAbroadMDs, LLC, a New York limited liability company (“MyAbroadMDs,” “we,” “us,” or “our”).

By accessing the Platform, creating an account, purchasing a membership, or otherwise using the Platform, you agree to these Terms and our Privacy Policy (together, the “Agreement”). If you do not agree, do not use the Platform.


1. Who We Are and What We Provide

MyAbroadMDs is a healthcare preparedness and informational resource platform for international travelers. The Platform provides city-specific healthcare information and related travel-health resources intended to help users prepare before departure and locate healthcare options abroad if needed.

The Platform may include information about healthcare providers and facilities (e.g., physicians, clinics, hospitals, urgent care centers, pharmacies, and telehealth resources) (collectively, “Providers”). However, MyAbroadMDs is not a healthcare provider and does not provide medical advice, diagnosis, treatment, prescriptions, insurance, emergency services, or medical referrals.


2. No Medical Advice; No Provider Relationship

The Platform is provided for informational purposes only.

We do not practice medicine. We do not diagnose, treat, prescribe, or provide clinical decision-making. We do not provide emergency response services. We do not create a doctor–patient relationship between you and MyAbroadMDs. We do not vouch for or otherwise guarantee the services of any Provider.

For the avoidance of doubt:


3. Not for Emergencies

DO NOT use MyAbroadMDs for emergency medical needs.

If you believe you have a medical emergency, contact local emergency services immediately (for example, dial the local emergency number) and follow any applicable program, insurance, school, employer, or institutional protocols.

The Platform may include general travel-safety resources (including, in some instances, emergency contact information) as part of certain membership materials or resource guides. Such information is provided for convenience only, may be incomplete or outdated, and is not guaranteed by MyAbroadMDs. You are solely responsible for knowing and using the appropriate local emergency number and resources based on your location.


4. Provider Listings and Information Accuracy

Provider information on the Platform may be compiled from one or more of the following: (a) publicly available sources, (b) information submitted by Providers, and/or (c) information collected through reasonable verification efforts (for example, confirming contact details when feasible).

Provider information may change without notice (including phone numbers, locations, hours, staffing, language availability, availability, and services). We do not guarantee the accuracy, completeness, timeliness, suitability, availability, or results of any Provider listing.

4.1 Star Indicators and “Popular with Members” Designations (If Displayed). Certain Provider listings may display star icons or similar indicators. These indicators reflect aggregated user engagement patterns and/or general feedback trends within the Platform. They are informational only and do not constitute endorsements, certifications, rankings, or guarantees of quality; do not imply a referral relationship; and do not reflect any clinical evaluation or assessment of medical competence.


5. No Booking, No Scheduling, No Payment for Medical Care

You acknowledge and agree that MyAbroadMDs does not schedule, confirm, manage, or cancel appointments with Providers; does not process payments for medical services provided by Providers; and that any appointment, payment, insurance claim, reimbursement, or dispute regarding medical services is strictly between you and the Provider.


6. Memberships, Fees, and Purchase Terms

MyAbroadMDs may offer memberships that provide access to Platform features and resources. Membership details, pricing, and what is included are described on the Platform and may change from time to time.

Payments. Membership fees are charged via our checkout process through third-party payment processors.

Renewals. Memberships do not renew automatically and must be repurchased to continue access after the end of the purchased term.

Refunds and Cancellations. Membership refund eligibility is governed by our refund policy as presented at checkout and/or on the Platform. If no refund policy is posted, membership fees are non-refundable except where required by law. If you cancel or do not repurchase a membership, your access to membership features will end when your then-current paid term ends.


7. Care Beyond Borders; Introductory Communications (If Included)

Certain memberships (currently, the “Care Beyond Borders” membership) may include introductory communication assistance intended to help users identify potential specialists abroad before travel.

If you request this assistance, you acknowledge and agree:


8. Telehealth Resources (If Listed)

The Platform may include information about telehealth services or Providers that offer remote consultations and/or in-person follow-up visits.

You acknowledge and agree: (a) MyAbroadMDs does not provide telehealth services; (b) telehealth availability, prescribing rules, and legality vary by jurisdiction; and (c) you are solely responsible for complying with local laws and for determining whether telehealth services are lawful and appropriate based on your location.


9. PIMS Vault; Device-Based Storage

The Platform may include a Personal Information Management Sheet/Vault (“PIMS”) feature designed to help users organize personal health and travel information.

Unless explicitly stated otherwise: (a) PIMS is intended to be device-based and self-managed by you; (b) MyAbroadMDs does not access, store, or retrieve your PIMS contents; and (c) you are solely responsible for the privacy and security of information stored on your device.


10. Eligibility; Minors

You must be at least 18 years old to create an account, purchase a membership, or use the Platform unless a parent/guardian provides consent where permitted by law.

If you use the Platform on behalf of another person (including a minor), you represent and warrant you have authority to agree to these Terms on their behalf.


11. Accounts and Security

If you create an account, you agree to provide accurate information, keep your login credentials confidential, and notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts for suspected fraud, misuse, or violations of these Terms.


12. User Content; Reviews (If Applicable)

If you submit reviews, feedback, or other content (“User Content”), you agree that your User Content is truthful and based on your personal experience (if presented as such), and does not violate privacy, defame, threaten, harass, or infringe rights.

We may remove User Content at our discretion.

License. You grant MyAbroadMDs a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute User Content for Platform operations and marketing, subject to our Privacy Policy.


13. Intellectual Property; Limited License; No Sharing

The Platform and its contents (including text, graphics, design, compilation, curation, databases, and software) are owned by MyAbroadMDs or its licensors and are protected by intellectual property laws.

Subject to these Terms, MyAbroadMDs grants you a limited, revocable, non-transferable, non-sublicensable license to access and use the Platform for your personal, non-commercial use during an active membership term (if applicable).

You may not copy, download in bulk, scrape, reverse engineer, resell, commercially exploit, or distribute Provider listings or other Platform content without our prior written permission. You may not share, post, republish, or otherwise distribute any curated directory or substantial portion of the Platform content to third parties.


14. Prohibited Uses

You agree you will not: use the Platform for unlawful purposes; attempt to access non-public areas or other users' data; scrape, crawl, data-mine, or harvest listings; impersonate others or provide false information; interfere with Platform operations; or use the Platform to harass, threaten, or defame Providers or users.


15. Third-Party Links and Services

The Platform may contain links to third-party sites. We do not control and are not responsible for third-party content, privacy practices, services, or products.


16. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYABROADMDS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND AVAILABILITY.

WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PROVIDER INFORMATION WILL BE ACCURATE OR UP TO DATE.


17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYABROADMDS AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYABROADMDS' TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO MYABROADMDS FOR YOUR MOST RECENT MEMBERSHIP DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.


18. Indemnification

You agree to defend, indemnify, and hold harmless MyAbroadMDs and its affiliates and representatives from any claims, liabilities, damages, losses, and expenses (including attorneys' fees) arising from or related to: your use of the Platform; your violation of these Terms; your interactions with any Provider; your User Content; or your violation of any law or third-party rights.


19. Dispute Resolution; Binding Arbitration; Class Action Waiver; Governing Law

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO PARTICIPATE IN A CLASS ACTION.

19.1 Agreement to Arbitrate. You and MyAbroadMDs agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, the Platform, any membership purchase, or your use of MyAbroadMDs services (collectively, “Disputes”) shall be resolved exclusively through final and binding arbitration, except as expressly provided below. This agreement applies to all Disputes, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory. By agreeing to these Terms, you and MyAbroadMDs waive the right to a trial by jury.

19.2 Arbitration Procedures. Arbitration shall be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules in effect at the time the arbitration is initiated. Unless otherwise required by applicable law, the arbitration shall take place in New York County, New York.

19.3 Class Action and Representative Action Waiver. To the fullest extent permitted by law: (a) all Disputes shall be brought solely on an individual basis; (b) neither you nor MyAbroadMDs shall seek to have any Dispute heard as a class action, collective action, consolidated action, or representative proceeding; and (c) the arbitrator shall not have authority to conduct any form of class, collective, consolidated, or representative proceeding.

19.4 Exceptions. Either party may bring an individual claim in small claims court if the claim qualifies, and either party may seek injunctive or equitable relief in a court of competent jurisdiction for intellectual property infringement or misuse.

19.5 Governing Law. These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles.


20. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on the Platform and update the “Last Updated” date. Continued use of the Platform after changes become effective constitutes acceptance.


21. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.


22. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and MyAbroadMDs regarding the Platform and supersede prior agreements or understandings.
